The processing of personal data is carried out in compliance with the General Data Protection Regulation (“GDPR”) and the Austrian Data Protection Regulation in its current form.

1.2. In this privacy policy, we would like to inform you about the nature, scope and purpose of the collection and use of personal data. This policy is intended to give you an insight into how LineMetrics processes and uses personal data.

2. Controller

2.1. The controller for the processing of personal data within the meaning of the GDPR is LineMetrics. If you have any concerns regarding our privacy policy, you can contact us by e-mail (office@liemetrics.com).

2.2. You can contact our data protection officer within the meaning of the GDPR by e-mail or via our help center. If you have any questions regarding the processing of your personal data, please contact our data protection officer in confidence.

3. What data we process

3.1. Generally. LineMetrics processes personal data that customers will pass on to LineMetrics (through the use of the products).

3.2. Information you provide to us. Mandatory disclosures: You must provide us with certain truthful information in order to register to use the LineMetrics products:

  • E-mail address
  • Name and surname

In order to purchase a physical or digital product from LineMetrics, you will need to provide additional data, such as:

  • Delivery and billing address, postal code, city, country
  • Phone number (for delivery by a shipping service provider such as FedEx, UPS,…)
  • Payment

Optional information:

Certain information is optional during registration and can be added later by you or made available through permission releases. Examples include:

  • Date of birth
  • Photo
  • GPS position

3.3. Third-Party Data. We receive the following personal data from external services (without being explicitly transmitted by the user):

  • IP address
  • Language (based on browser settings)
  • Country (based on the language(s) in the browser)

4. Use of external services and data transfer to third parties

Use of external services

Google Analytics

General. The LineMetrics website uses Google Analytics, a web analytics service provided by Google Inc., Google Analytics uses cookies. The information generated by the cookies about your use of this website is usually transmitted to a Google server in the USA and stored there. However, if IP anonymization is activated in the Products, your IP address will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the products, to compile reports on project activities and to provide other services related to website activity and internet usage. The IP address transmitted by your browser as part of Google Analytics will not be merged with other data held by Google.

Opt out. You can prevent the collection of data by the cookie regarding your use of the products (including your IP address) as well as their processing by Google by downloading and installing the following browser plugin: https://tools.google.com/dlpage/gaoptout?hl=de.

Anonymize IP. The Products use Google Analytics in conjunction with the “_anonymizeIP ()” option. This means that IP addresses are processed in an abbreviated form in order to prevent the transmission of personal data. Any connection with a specific person is therefore excluded and personal data is immediately deleted.

Purpose. LineMetrics uses Google Analytics to analyze the use of LineMetrics products and to be able to continuously improve them. Through the statistics, LineMetrics is able to improve its services and make them more interesting for users and optimize new features and products. In the specific cases where personal data is transferred to the United States, Google is certified through the EU-US Privacy Shield. The basis for the processing is Art. 6 para. 1 et seq. GDPR.

Webshop Fulfillment/Shipping/Tracking:

For the (partially) automated processing of orders, we transmit data provided by you and necessary for the provision of the delivery service to the respective shipping service provider for the proper delivery of products ordered in the online shop. LineMetrics works primarily, but not exclusively, with UPS, FedEx, and Austrian Post. In some regions or countries, so-called dropship service providers are used, which are responsible for the proper processing of shipping. In these countries and regions, the information required for these purposes (name, address, e-mail address, telephone number, if applicable) is transmitted digitally to the service provider solely for this purpose and not for further use.

Zoho SalesIQ / Page Sense / Marketing Automation

When you visit our website, anonymised usage data is collected. Zoho anonymously records activity on our website and allows us to review the use of the website and make the content better. Personal data is collected. Furthermore, “cookies” are used to enable an analysis of the use of our website. You can prevent this by making the appropriate settings in your browser.

Pipedrive Customer Management
In order to be able to process and respond to your concerns and messages as quickly as possible, we have connected our contact form with our customer relationship management tool (“CRM tool”) Pipedrive. The data transmitted when filling out the form will be transmitted to Pipedrive and stored there on Pipedrive’s servers.

We use the CRM system Pipedrive of the provider Pipedrive OÜ on the basis of our legitimate interests (efficient and fast processing of user requests, existing customer management, new customer business), a private limited company established under the laws of the Republic of Estonia, with address Paldiski mnt 80, Tallinn, 10617, Estonia, registered in the Estonian Commercial Register under the code 11958539, and a subsidiary of Pipedrive US. To this end, we have concluded a contract with Pipedrive with so-called standard contractual clauses, in which Pipedrive undertakes to process user data only in accordance with our instructions and to comply with the EU level of data protection. Pipedrive US is also certified under the Privacy Shield Framework, which provides an additional guarantee of compliance with European data protection law. Your data will be deleted in our CRM tool Pipedrive when we have processed your request and the purpose of storage has ceased to apply and there are no other conflicting legal exceptions. You can find out about the data stored about you at any time.

LineMetrics products include social media plugins. Such plugins may recognize a user’s IP address and the page visited on the LineMetrics platform, and may store cookies so that the services offered by LineMetrics function properly. Some apps may use third-party features (e.g., Facebook, LinkedIn) through the third-party SDK (Software Development Kit) that can process general device data (e.g., device ID, etc.). Social media plugins and widgets are either hosted by third parties or hosted directly by us. Your interactions with these plugins are subject to this Privacy Policy or the privacy policies of third parties that offer such features.

LINEMETRICS IS NOT RESPONSIBLE FOR THE USE OF THE DATA BY THIRD PARTIES OR FOR THE GUIDELINES FOR THE USE OF THE DATA BY THIRD PARTIES!

Users can recognise the relevant third-party plugins, for example by the respective logo or by other characteristics typical of the respective social media platform.

If a user interacts with the plugins, e.g. by clicking on the Facebook “Like” button or by entering a comment while the user is logged into a social media account, the user profile of the social media page may be linked to it. This allows the social media platforms to associate a user’s visit or use of the products with a user’s social media account. As the provider of the products, LineMetrics has no knowledge of the content of the transmitted data or its use by the social media platforms. Users can find further information on the subject of data transfer in the privacy policy of the respective social media platform.

If users do not want the respective social media platform to link their visits to our site to their social media account, users must log out of their social media account before using LineMetrics.

6. Why we process your data (reasons)

6.1. Use of the Products

We process your data in order to provide you with the best possible user experience when using the products.

Sale and shipping of products. To sell our products and ensure the shipment of physical products.

Products and Services. To use the products and services, e.g. to verify your access data.

Customer service. To investigate and process customer inquiries (for example, via the customer service website) in order to resolve and respond to them and, if necessary, to be able to deal with complaints and service problems.

6.2. Business Requirements

We process your data to meet our business needs, but only as long as your rights and interests do not override ours. This includes advertising and marketing in general.

Performance

We process data to monitor, analyze and improve the use of our products and services and to protect the security and/or integrity of the products and their performance and functionality. For example, we analyze user behavior and conduct research about how our users use our services, hardware, and other products.

Research and development

We process data, including public feedback, in order to drive the further development of our products through research and development and to provide a better, more intuitive and personal experience for our users, and to promote user growth and engagement in our products.

Marketing in general

We process data for you by delivering (tailored) marketing material about LineMetrics products and online services or LineMetrics’ products and services.

Advertising

We measure the accuracy of our ads to registered users and visitors.

Newsletter/Push News Marketing

With your consent to the GTCC and, subsequently, to the Privacy Policy, we will send you newsletters with information on topics related to the product.

Retargeting

You may see marketing messages (ads) on different platforms (e.g. Google, Facebook, …). In addition, other users who have similar characteristics/interests to you on these platforms could also see marketing messages on these platforms (e.g., Facebook lookalike audience).

6.3. Compliance & Enforcement

Compliance: We process your data to comply with our obligations and to comply with all applicable laws and regulations.

Enforcement: We process your information when we believe it is necessary for security purposes or to investigate possible fraud or other violations of our Terms of Use or this Privacy Policy and/or if there is a suspicion that an attempt is being made to cause harm to our users or customers.

7. Newsletter & Push Notifications

7.1. Newsletter

Registration / Cancellation / Revocation

We only send newsletters under the following conditions:

The customer registers for our newsletter list via our website www.linemetrics.com. In this case, the registration takes place in a so-called double opt-in procedure. Specifically. After registration, you will receive an email asking you to confirm your registration. This confirmation is necessary so that no one can log in with someone else’s email addresses.
By creating a LineMetrics user account and accepting the LineMetrics Terms and Conditions at the same time.

You can unsubscribe from our newsletter at any time, i.e. Withdraw your consents. This means that your consent to its sending via MailChimp and the statistical analyses expire at the same time. Unfortunately, it is not possible to revoke the sending via MailChimp or the statistical evaluation separately.

Use of the shipping service provider “MailChimp”

The newsletter is sent via “MailChimp”, a newsletter distribution platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA.

The e-mail addresses of our newsletter recipients, as well as their other data described in this notice, are stored on the servers of MailChimp. MailChimp uses this information to send and evaluate the newsletters on our behalf. Furthermore, MailChimp may use this data to optimize or improve its own services, e.g. for the technical optimization of the sending and presentation of the newsletter or for economic purposes to determine from which countries the recipients come. However, MailChimp does not use the data of our newsletter recipients to write to them itself or passes on the data to third parties.

We trust in MailChimp’s reliability and IT and data security. MailChimp is certified under the US-EU data protection agreement “Privacy Shield” and is thus committed to complying with EU data protection regulations. You can view MailChimp’s privacy policy here.

Statistical collection and analysis

The newsletters contain so-called “tracking pixels”, which enable the creation of statistical surveys and analyses. This “pixel” collects technical information, such as information about the browser and your system, as well as your IP address and time of access. This information is used for the technical improvement of the services on the basis of the technical data or the target groups and their reading behaviour on the basis of their retrieval locations (which can be determined with the help of the IP address) or the access times.

The statistical surveys also include determining whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to the individual newsletter recipients. However, it is not our ambition, nor that of MailChimp, to monitor individual users. The evaluations are much more useful for us to recognize the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.

8. Disclosure of Personal Data

8.1. General.

We only transfer data to third parties for good cause, including in response to a request from a national authority, police department or criminal investigation department, due to a court ruling that requires us to disclose data in order to defend ourselves against claims or allegations made by third parties, to exercise and/or protect the rights and safety of LineMetrics, our users, employees or others, or if you have previously consented. We will attempt to notify you of legal requirements for your personal information when we believe it is appropriate to do so, unless prohibited by law or court or in the event of an emergency. We may dispute such claims if we believe, in our discretion, that the requests are too broad, vague or unreasonable, but we do not promise to contest every claim.

8.2. Service Providers and Third-Party Services.

We transfer your information to others who help us provide and improve our products (e.g., maintenance, analysis, audit, payments, fraud detection, marketing, and development). Service providers will have access to your information to the extent necessary for us to perform these tasks and are obligated not to disclose or use that information for any other purpose. The list of our service providers/third-party service providers can be found in Section 4.

9. How long we store data

9.1. Retention period

We store your data for as long as you are a registered LineMetrics user. In addition, we store data if required by law (due to warranty, limitation or retention periods) or if it is otherwise required.

9.2. Deletion of personal data

If you decide to delete your account, any personal information we have about you will be deleted, with the following exceptions:

  • All data that is necessary for the fulfilment of contractual obligations or compliance with statutory retention obligations by LineMetrics may not be deleted, but minimized to the extent necessary.
  • Data that is used to uniquely identify a customer (e.g. e-mail address) is anonymized by deletion, so that it is no longer possible to draw conclusions about the identity of the user.
  • The personal data that a customer transmits to us with the deletion request remains stored in our customer service software. The data transmitted to LineMetrics in the course of this customer request will not be further processed and will only be used to document the deletion request.

A deletion request does not affect data if retention is required by law, for example for accounting or billing purposes.

10. Your rights

10.1. Exercising your rights

To exercise the rights defined in clauses 10.2 to 10.8, please send a request by e-mail to our e-mail address or by post to our postal address.

10.2. Withdrawal of consent

You can revoke your consent for future data processing at any time. However, this does not affect the lawfulness of the data processing based on consent before the withdrawal.

10.3. Access right

You have the right to: (i) obtain confirmation as to whether your data is being processed by us and, if so, (ii) obtain specific information about the data.

10.4. Right to rectification

You have the right to obtain from us the correction of inaccurate data concerning you. If the data we process is incorrect, we will immediately remove/rectify it and inform you of this correction.

10.5. Right to erasure

If you decide that we do not want us to process your data any further, please contact us by e-mail. We will delete your account and delete your data. If mandatory legal provisions prevent such deletion, we will inform you.

10.6. Right to data portability

You have the right to receive your data in a structured, commonly used and machine-readable format.

10.7. Right to object

You have the right to object at any time to the processing of data for which our legitimate interests are the legal basis, including profiling on the basis of these provisions.

10.8. Right to lodge a complaint

You have the right to lodge a complaint with a supervisory authority (in Austria: Data Protection Authority) if you believe that the processing of data violates applicable law, in particular the GDPR.

11. Other important information

11.1. Legal basis

The General Data Protection Regulation regulates that we may only collect, store and process data for which we have a legal basis to process it. The legal basis for this comes from

Legitimate interests include the protection of the user, the protection of LineMetrics and/or the protection of third parties from security breaches, threats and (attempted) fraud. Other interests include compliance with applicable laws, managing and improving the company (customer service, reporting) as well as possible business transactions (e.g. M&A). Legitimate interests also include the ability to share images, data or other information of the user with other users or the public at the request of the user.

The following processing operations are based on LineMetrics’ legitimate interests:

  • Processing of data relevant to billing in order to comply with the legal provision of accounting (e.g. determination of the tax rate based on the country selected by the customer).
  • Processing demographic data in aggregate form to create reports for the betterment of the business.
  • Processing of e-mail address, delivery address, billing address and IP address for the detection of potential fraud.
  • Processing of the IP address for the detection and defense against potential attacks on the software system of LineMetrics.

11.2. Security Measures

In order to ensure unauthorized access to your data as well as the data of all LineMetrics users, LineMetrics uses state-of-the-art security software and technologies.

11.3. Pictures

If you upload photos that show other people, you confirm that they have been notified of this photo upload and have consented to it.

11.4. Use by minors

Persons under the age of 18 may not submit any personal data to LineMetrics without the consent of their legal guardians. Minors may only provide personal information to LineMetrics with the express consent of their legal guardians.

12. Changes to the Privacy Policy

12.1. General

LineMetrics reserves the right to change the Privacy Policy at any time.

12.2. Significant changes

If we make significant changes to our Privacy Policy, we will notify our users directly in the Apps, on the Website and/or via email so that users can review the changes before they become effective. Significant changes include more detailed tracking or profiling or the addition of detailed analysis services. If we require the user’s consent to make a change, we will obtain it before the changes take effect. If a customer does not agree with the changes, it is possible to close the account at any time and delete the user’s data completely and permanently.

By using the LineMetrics products (apps, website and services) after being informed of changes in the privacy policy, you confirm your consent to the persistence, use, evaluation and disclosure for the purposes specified in the privacy policy.
